Terms Of Service (Regular Commissions)
I. IMAGE COPYRIGHT AND GUIDELINES-The artist retains full rights to the original artwork, which includes advertising, and displaying the work on their websites, social media, and portfolios. The client may not claim it as their own or use it for anything other than personal use.
-All commissioned artwork is for noncommercial purposes only. Redistribution of my artwork for use in printed merchandise or as promotion of goods, services or social media pages is prohibited.
-If the client wants to commission something for commercial purposes, whether it is for use in printed merchandise or as promotion of goods, services or social media pages, or other uses, prices will be different and a separate contract will be made with different Terms Of Service.Conditions for Reposting
-The client has my permission to repost the artwork where they would like, as long as proper credit is given (a link back to my twitter/twitch page is preferred) and my watermark(s)/signature(s) remains intact and unaltered.
-Do not repost and tag the artwork with lgbtphobia, racism, ableism or other forms of hate or offensive language.Prohibited Actions
-Altering the artwork in any way without asking for permission beforehand, with the exception of cropping the image for an icon or other use.
-Using the artwork as heavy references for your own, whether it is tracing or re-purposing parts of the image.
-Using the artwork as NFTs (non-fungible tokens) or in AI learning.II. PAYMENT INFORMATION-I, the artist, only take payment in EUR through Paypal invoice. ALL payments are to be made through Paypal
-Payment is due within 24 hours of the Paypal invoice. If additional time is needed for payment the commissioner must make this request within 24 hours, otherwise the commission may be cancelled.
-Trusted clients (see section VI) may receive the option for partial payment with a longer deadline. For bigger projects the terms may be negotiated, but for smaller projects a minimum of 30% must be paid before any work on the commission is started.III. REFUND POLICY-If the commission is cancelled before work has started, then the client will receive a full refund.
-If the client cancels the commission during progress, the amount refunded will be on a case-by-case basis and up to the artist’s discretion.
-For example, here is a rough guideline for shaded commissions:
Sketch: 75%
Lineart: 40%
Lineart and Flat Color: 20%
-No refunds will be given for completed or nearly completed commissions.
-The artist reserves the right to cancel a commission at anytime, for any reason, and without explanation. If the commission has been started the artist and the client will discuss and agree on a partial refund that is fair for the amount of work done.IV. CONTACT AND COMMUNICATION-Discussion of commissions can be conducted through email ([email protected]) or Discord (xinyithings).
-Client must provide at least one clear and concise visual reference; please supplement the visual reference with any important information I may need to know to correctly draw the character.
-Personal Information like email addresses, legal names, and other data will not be stored. All information will be handled confidentially.V. WORKFLOW PROCESS-Works in Progress (WIPS). Certain commission types may or may not include a sketch approval stage. WIPs that the artist sends are not to be reposted anywhere or sent to anyone without permission. At any time you may ask for progress of your piece, but it is not guaranteed that they will have much or any of it done.
-Revisions and edits. If the commission type includes a sketch approval stage, any major changes or revisions must be made at this stage; this includes any significant changes to a character’s pose or body shape, or redrawing parts of the image.
-After the sketch has been approved, no major edits or changes will be made. If the commissioner requests additional edits after the approved sketch, a price for the edits may be discussed.
-If the artist makes any errors in the character design, accessories, or any other visual elements specified in the provided visual references, they will make these edits at no additional cost.
-If the commissioner provides an unsuitable reference with errors in the character design, accessories, or any other visual elements, the artist may ask for additional payment, as it is not their fault for drawing it incorrectly.
-If you do not want me to post your commission online, record or stream the commission process, you must tell me BEFORE I start the commission. I don't have to and will not ask for permission to stream, record and post the commission.VI. ADDITIONAL NOTES
-If the client wants to negotiate terms or do anything not specified in the terms of service (for example, commercial use or a different payment method), we may come to an agreement. In that case, a separate unique contract will be drawn up specifically for the client’s needs.
-'Trusted Clients' refers to clients who have commissioned the artist previously. Alternatively, if the client has frequently commissioned other artists, they may be given a chance to become a trusted client upon providing testimonies from said artists as proof of good character and etiquette.

I am doing a NSFW series, where I draw a female character in their underwear, face out of frame.
